1. About These Terms

These Terms & Conditions ("Terms") govern your use of the website breatheherenow.io and your purchase of any sessions, programmes, events, or other services offered under the name Breathe Here Now.

Breathe Here Now is operated by Breath Point OÜ, a company registered in Estonia (company no. 17418554), registered address c/o Digireport Services OÜ, Tornimäe 5, 10145 Tallinn, Estonia ("we", "us", "our"). The breathwork facilitation is delivered by Sean Paul.

By booking, purchasing, or using our services, you agree to these Terms. Please read them alongside our Privacy Policy, which explains how we handle your data.

2. Definitions

"Services" — breathwork sessions, multi-session packages, programmes, group events, immersions, and any related offering, delivered online or in person.

"You" / "Client" — the person booking or purchasing the Services.

"Programme" — a multi-session package or course (for example The Three, The Six, Functional Breath Foundation, Functional Breath Mastery, The Breath Arc).

"Group event" — a dated, limited-capacity session (for example a Breathe Alive Circle, Breath & Cold, or The Full Breath Day).

3. The Services

We offer breathwork facilitation in a range of formats, online and in person. The details, length, and price of each offering are described on the website at the time of booking.

Our Services are practices for wellbeing, self-exploration, and breath education. They are not medical treatment, psychotherapy, or a substitute for professional medical or mental-health care. See §7.

We may update, reschedule, or withdraw an offering. Where we change or cancel something you have already paid for, §6 applies.

4. Booking and Payment

Prices are shown in euros (EUR) and are payable in full at the time of booking unless a payment plan is offered.

Prices are not subject to VAT: Breath Point OÜ operates under the small-business VAT exemption (exemption no. EE17418554-EX), which appears on invoices where required.

Online payments are processed securely by our payment provider (Stripe). In-person payments may be taken by card (Revolut Business) or in cash.

A booking is confirmed once payment (or the agreed first instalment) is received and you receive confirmation.

Payment plans (where offered, e.g. Functional Breath Mastery and The Breath Arc) split the total into agreed instalments. By starting a payment plan you commit to the full programme fee; see §6.4.

5. Your Right to Withdraw (Online Purchases)

If you are a consumer in the EU/EEA buying online, you have a statutory right to withdraw from a purchase within 14 days, subject to the following:

If you ask us to begin a Service within the 14-day period, you agree that we may start, and you lose the right to withdraw in respect of any part of the Service already provided. You would be charged for sessions already delivered; any balance is refunded.

The 14-day withdrawal right does not apply to dated group events, which are leisure services provided on a specific date. For those, the event terms in §6.3 apply instead.

6. Cancellation, Rescheduling & Refunds

We're a small practice and your booked time is held exclusively for you. These terms keep things clear and fair on both sides.

6.1 — One-to-One Sessions (Including Entry Sessions)

You may reschedule or cancel with at least 48 hours' notice before your session, at no charge — we'll find another time or refund you.

Cancellations or reschedules with less than 48 hours' notice may be charged in full, as the time has been reserved for you.

We may waive this at our discretion — for example in the case of genuine illness or emergency. This flexibility is ours to offer; please don't rely on it.

6.2 — Programmes (The Three, The Six, Foundation, Mastery)

You may cancel for a full refund within 14 days of purchase, provided the programme has not yet started.

If the programme has started within that period, we refund the balance less the value of any sessions already delivered.

After 14 days, or once the programme is underway, the fee is non-refundable. Within a reasonable validity period, individual sessions can be rescheduled under §6.1.

6.3 — Group Events (Circles, Breath & Cold, The Full Breath Day)

These have fixed dates and limited spaces.

Full refund if you cancel 7 or more days before the event.

Within 7 days, the fee is non-refundable, but your place is transferable — you may move to another date or pass your spot to someone else.

If we cancel an event, you receive a full refund or a transfer, your choice.

6.4 — Payment Plans

Once a payment-plan programme has started, the full programme fee remains payable, including any remaining instalments. A payment plan is a way to spread the cost, not a per-session subscription you can stop partway.

Missed instalments may pause access until resolved.

6.5 — No-Shows

If you do not attend a booked session without notice, the session is forfeited and not refunded.

6.6 — The Breathe Here Now Diamond

The Diamond is arranged individually. Its terms, including any deposit and cancellation arrangements, are agreed in writing before it begins and take precedence over this section for that engagement.

7. Health, Safety & Your Responsibilities

Breathwork can be physically and emotionally powerful. Your safety depends partly on you being honest with us.

You agree to disclose any relevant health conditions before participating — including (but not limited to) pregnancy, cardiovascular conditions, high or low blood pressure, epilepsy or seizure history, respiratory conditions, recent surgery, or significant psychiatric history.

Certain conditions are contraindications for some practices. We may decline or adapt a session for your safety. If in doubt, consult your doctor before participating, and tell us of anything relevant.

Our Services are not a diagnosis, treatment, or cure for any medical or psychological condition, and are not a substitute for medical or mental-health care. Do not stop or change any prescribed treatment on the basis of a session.

You participate voluntarily and at your own risk, and you are responsible for stopping or stepping back at any point if something doesn't feel right.

Minors: we work with under-18s only with the written consent of a parent or guardian, who provides health and booking information and signs on their behalf.

Clients confirm a separate Health, Consent & Waiver declaration before their first session — this forms part of these Terms.

8. Nature of the Services — No Guaranteed Outcomes

People experience breathwork differently. While many people find the work valuable, we don't promise any specific result or outcome. Nothing on our website or in our communications should be taken as a guarantee of a particular benefit.

9. Conduct

We want every session to be safe and respectful. We may decline service to, or end a session with, anyone whose behaviour is abusive, unsafe, or under the influence of alcohol or drugs in a way that makes safe participation impossible. No refund is due in these circumstances.

10. Intellectual Property

All content on breatheherenow.io — text, images, frameworks, recordings, and materials shared during Services — belongs to us or our licensors and is for your personal, non-commercial use. Please don't copy, redistribute, or resell it without our permission.

11. Liability

To the fullest extent permitted by law:

We are not liable for any indirect or consequential loss arising from your use of the website or Services.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under applicable law.

Our total liability in connection with any Service is limited to the amount you paid for that Service.

Your statutory rights as a consumer are not affected by this section.

12. Privacy

We handle your personal data in line with our Privacy Policy, which forms part of these Terms. Please read it to understand what we collect and why.

13. Governing Law

These Terms are governed by the laws of Estonia, and disputes fall under the jurisdiction of the Estonian courts. If you are a consumer resident in another EU/EEA country, you also keep the protection of any mandatory consumer-protection rules of your country of residence, and may have access to the EU Online Dispute Resolution platform.

14. Changes to These Terms

We may update these Terms from time to time. The version in force is the one published here at the time of your booking. We'll update the "last updated" date when we make changes.
